These Terms of Service govern purchases from and use of the Meridian Quiet online store.

By placing an order, you agree to these Terms together with any policies incorporated by reference, including our Returns & Refunds Policy, Shipping Policy, and Privacy Policy.

Nothing in these Terms excludes or limits any consumer right or remedy that cannot lawfully be excluded or limited.

1. Seller

Meridian Quiet is an independent vintage costume jewelry business operated from Japan.

Legal seller information is provided in the Legal Notice below.

2. Eligibility and adult-use products

Our vintage costume jewelry is intended for adult use and collecting and is not intended for children.

By placing an order, you confirm that you have legal capacity to enter into the transaction.

3. Products

Unless expressly stated otherwise, items sold by Meridian Quiet are vintage and pre-owned.

Vintage items may show signs of age, previous use, storage, or manufacture, including minor scratches, patina, plating wear, discoloration, variations in finish, or other age-related characteristics.

We make reasonable efforts to describe and photograph each item accurately. Product photographs and condition notes form part of the product description.

Colors and appearance may vary slightly depending on lighting, photography, screens, and display settings.

Measurements and estimated dates may be approximate unless expressly stated otherwise.

4. Materials and metal composition

Vintage costume jewelry may have been manufactured using materials, alloys, plating processes, solders, coatings, adhesives, stones, or other components that differ from those used in contemporary jewelry.

Unless expressly stated otherwise for a particular product, the exact metal and chemical composition of our vintage jewelry has not been independently tested.

Accordingly, unless specifically stated on the relevant product page, we do not represent or warrant that an item is:

• lead-free;
• cadmium-free;
• nickel-free;
• hypoallergenic;
• suitable for sensitive skin; or
• compliant with a particular modern voluntary material standard.

Customers with known metal sensitivities or allergies should take this into consideration before purchase.

Nothing in this section limits any product-safety obligation or consumer right imposed by applicable law.

5. Pricing

Prices are displayed in the currency made available through our store or Shopify Markets.

Prices may change without notice before an order is placed.

The price applicable to an order is the price displayed and accepted through checkout at the time the order is placed, subject to correction of an obvious technical or pricing error as permitted by applicable law.

6. Orders

Submitting an order does not require us to accept an order that cannot lawfully or reasonably be fulfilled.

We may cancel an order before shipment where reasonably necessary, including where:

• the item is no longer available;
• an inventory error has occurred;
• payment cannot be verified;
• fraud or unauthorized activity is reasonably suspected;
• the shipping address is in a jurisdiction we do not serve;
• shipment would violate applicable law or carrier restrictions; or
• an obvious material pricing or technical error has occurred.

If we cancel an order after payment has been collected, the amount collected for the cancelled order will be refunded.

7. Availability and one-of-a-kind items

Many Meridian Quiet products are one-of-a-kind vintage items.

An item may therefore become unavailable without a replacement being available.

Adding an item to a shopping cart does not reserve it unless the checkout system expressly states otherwise.

8. Payment

Available payment methods are shown at checkout.

Orders may be subject to payment verification and fraud-prevention review.

Your bank, card issuer, or payment provider may impose its own currency-conversion or international transaction fees. Such third-party fees are outside Meridian Quiet’s control.

9. Shipping

Shipping is available only to destinations currently supported by our store.

Our current primary shipping destinations are:

• Japan; 
• United States, excluding California and Vermont;
• Canada, excluding Manitoba, Québec, and Saskatchewan; and
• Australia.

10. Import requirements

Customers are responsible for ensuring that an item may lawfully be imported into the destination specified in their order.

Unless expressly collected at checkout, customs duties, import taxes, brokerage charges, and other destination-country charges are the recipient’s responsibility.

We will provide customs information truthfully and will not intentionally misstate the nature or value of merchandise.

11. Returns and remedies

Our voluntary change-of-mind return conditions are described in our Returns & Refunds Policy.

Separate rights may apply when goods are faulty, unsafe, materially misdescribed, or otherwise fail to comply with mandatory consumer guarantees or other applicable law.

Nothing in these Terms or our Returns Policy excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded, restricted, or modified.

For Australian consumers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

12. Intellectual property

Unless otherwise stated, the text, original photography, graphics, branding, logos, website design elements, and original content created for Meridian Quiet are owned by or licensed to Meridian Quiet and may not be reproduced, republished, distributed, or commercially used without permission, except as permitted by law.

Third-party trademarks and brand names appearing in product descriptions remain the property of their respective owners.

References to vintage manufacturers or brands are used for identification and description of genuine or believed-to-be-genuine vintage items and do not imply sponsorship, affiliation, authorization, or endorsement unless expressly stated.

13. Prohibited use

You may not use this website:

• for unlawful or fraudulent purposes;
• to interfere with the security or operation of the website;
• to introduce malicious code;
• to attempt unauthorized access to accounts or systems;
• to scrape or systematically extract content in violation of applicable law; or
• to infringe intellectual-property or other legal rights.

14. Website availability

We may modify, suspend, or discontinue parts of the website or store where reasonably necessary.

We do not guarantee uninterrupted or error-free access to the website.

15. Limitation of liability

To the maximum extent permitted by applicable law, Meridian Quiet is not liable for losses that are indirect, consequential, or not reasonably foreseeable at the time of purchase.

This provision does not exclude or limit liability that cannot lawfully be excluded or limited, including rights and remedies available under applicable consumer protection law.

16. Governing law

These Terms are governed by the laws of Japan, without prejudice to any mandatory consumer-protection rights that apply to you under the law of your place of residence and cannot lawfully be excluded by agreement.

Any dispute will be handled in accordance with applicable law and any mandatory jurisdictional rights available to the consumer.

17. Changes to these Terms

We may update these Terms from time to time.

The version applicable to an order is the version made available when that order is placed, except where a change is required by law.

本利用規約は、Meridian Quietオンラインストアの利用および当店での商品購入に適用されます。

ご注文を行うことで、お客様は、本利用規約ならびに返品・返金ポリシー、配送ポリシーおよびプライバシーポリシーを含む、参照により本規約に組み込まれる各種ポリシーに同意したものとみなされます。

1. 販売者

Meridian Quietは、日本から運営されている独立系のヴィンテージコスチュームジュエリー事業です。

販売者に関する法的情報は、特定商取引法に基づく表記に記載しています。

2. 利用資格および成人向け商品

当店のヴィンテージコスチュームジュエリーは、成人による使用および収集を目的としており、子ども向けの商品ではありません。

ご注文を行うことで、お客様は当該取引を行うための法的能力を有していることを確認するものとします。

3. 商品

特に明記がない限り、Meridian Quietで販売する商品はヴィンテージまたは中古品です。

ヴィンテージ商品には、経年、過去の使用、保管または製造に伴い、小傷、パティナ、メッキの摩耗、変色、仕上げのばらつき、その他の経年変化が見られる場合があります。

当店は、各商品をできる限り正確に説明・撮影するよう努めています。商品写真および状態に関する記載は、商品説明の一部を構成します。

色味や外観は、照明、撮影条件、使用する画面や表示設定等により、実物と若干異なる場合があります。

特に明記がない限り、寸法や推定年代は概算である場合があります。

4. 素材および金属成分

ヴィンテージコスチュームジュエリーには、現代のジュエリーとは異なる素材、合金、メッキ方法、はんだ、コーティング、接着剤、石その他の部品が使用されている場合があります。

特定の商品について明示されている場合を除き、当店のヴィンテージジュエリーの正確な金属成分および化学成分について、独立した検査は行っていません。

そのため、各商品ページに明示されている場合を除き、当店は商品について以下を表示または保証するものではありません。

• 鉛を含まないこと
• カドミウムを含まないこと
• ニッケルを含まないこと
• 低アレルギー性であること
• 敏感肌に適していること
• 特定の現代的な任意規格に適合していること

金属に対する過敏症やアレルギーのあるお客様は、ご購入前にこの点をご考慮ください。

本項のいかなる規定も、適用法令に基づく製品安全上の義務または消費者の権利を制限するものではありません。

5. 価格

価格は、当店またはShopify Marketsを通じて利用可能な通貨で表示されます。

価格は、ご注文前であれば予告なく変更される場合があります。

注文に適用される価格は、適用法令により明白な技術上または価格表示上の誤りを訂正できる場合を除き、注文時にチェックアウト画面に表示され、お客様が承認した価格とします。

6. 注文

注文を送信したことにより、法令上または合理的に履行できない注文まで当店が受諾する義務を負うものではありません。

当店は、合理的に必要な場合、発送前に注文をキャンセルすることがあります。これには以下の場合が含まれます。

• 商品がすでに入手できない場合
• 在庫管理上の誤りがあった場合
• 支払いを確認できない場合
• 不正行為または無断利用が合理的に疑われる場合
• 配送先が当店の販売対象外地域である場合
• 発送が適用法令または配送業者の制限に違反する場合
• 明白かつ重大な価格表示または技術上の誤りがあった場合

支払い受領後に当店が注文をキャンセルした場合、キャンセルされた注文について受領済みの金額を返金します。

7. 在庫および一点物商品

Meridian Quietの商品には、一点物のヴィンテージ商品が多数含まれます。

そのため、商品が販売済みとなった場合、代替品をご用意できないことがあります。

チェックアウトシステム上で明示的に予約済みと表示されない限り、商品をカートに追加しただけでは在庫は確保されません。

8. 支払い

利用可能な支払方法は、チェックアウト画面に表示されます。

注文は、支払い確認および不正防止のための審査対象となる場合があります。

お客様の銀行、カード発行会社または決済サービス提供者が、独自の為替換算手数料や海外取引手数料を課す場合があります。これら第三者による手数料はMeridian Quietの管理外です。

9. 配送

配送は、当店が現在対応している地域に限り行います。

現在の主な配送対象地域は以下のとおりです。

• 日本
• アメリカ合衆国（California州およびVermont州を除く）
• カナダ（Manitoba州、Québec州およびSaskatchewan州を除く）

• オーストラリア

その他の配送条件、処理期間および通関情報については、配送ポリシーに記載しています。

10. 輸入に関する要件

お客様は、ご注文時に指定した配送先へ商品を適法に輸入できることを確認する責任を負います。

チェックアウト時に明示的に徴収される場合を除き、関税、輸入税、ブローカー手数料その他配送先国で課される費用は、受取人の負担となります。

当店は、通関情報を正確に申告し、商品の性質や価格を意図的に虚偽申告することはありません。

11. 返品および救済

お客様都合による任意の返品条件については、返品・返金ポリシーに記載しています。

商品に欠陥がある場合、安全上の問題がある場合、商品説明と重大に異なる場合、または強行的な消費者保証その他の適用法令に適合しない場合には、別途法定の権利が適用されることがあります。

本利用規約または当店の返品ポリシーのいかなる規定も、法令上排除、制限または変更することのできない権利または救済を排除、制限または変更するものではありません。

オーストラリアのお客様には、Australian Consumer Lawに基づき排除することのできない消費者保証が適用されます。

12. 知的財産権

特に明記がない限り、Meridian Quietのために作成された文章、オリジナル写真、グラフィック、ブランド要素、ロゴ、ウェブサイトのデザイン要素およびオリジナルコンテンツは、Meridian Quietが所有するか、または正当に使用許諾を受けたものです。

法令により認められる場合を除き、許可なく複製、再掲載、配布または商業利用することはできません。

商品説明に記載される第三者の商標およびブランド名は、それぞれの権利者に帰属します。

ヴィンテージメーカーやブランドへの言及は、真正品または真正品であると合理的に考えられるヴィンテージ商品の識別および説明を目的として使用するものであり、明示されている場合を除き、当該ブランドによる後援、提携、承認または推奨を意味するものではありません。

13. 禁止事項

• 知的財産権その他の法的権利を侵害する行為

14. ウェブサイトの提供

当店は、合理的に必要な場合、ウェブサイトまたはストアの一部を変更、一時停止または終了することがあります。

当店は、ウェブサイトへのアクセスが中断されないこと、またはエラーが発生しないことを保証するものではありません。

15. 責任の制限

適用法令により認められる最大限の範囲において、Meridian Quietは、購入時点で合理的に予見できなかった間接的損失または結果的損失について責任を負いません。

本規定は、適用される消費者保護法令に基づく権利および救済を含め、法令上排除または制限することのできない責任を排除または制限するものではありません。

16. 準拠法

本利用規約は日本法に準拠します。

ただし、お客様の居住地の法令に基づき適用され、契約によって排除することのできない強行的な消費者保護上の権利には影響を与えません。

紛争については、適用法令および消費者に認められる強行的な管轄上の権利に従って取り扱います。

17. 本利用規約の変更

当店は、本利用規約を随時更新する場合があります。

法令上変更が必要な場合を除き、各注文には、その注文時点で公開されていた利用規約が適用されます。
